REMOVAL FROM OFFICE   Policy Code:   2116

If the board of education receives notice from the State Board of Education that it has sufficient evidence that a member of the local board of education either:

  • is not capable of discharging, or is not discharging, the duties required by law; or
  • is guilty of immoral or disreputable conduct,

the local board of education will hold a hearing to investigate the charges. If the local board finds the charges to be true, it shall declare the office vacant. However, the offending member will be given proper notice of the hearing, an opportunity to hear the case against him/her and an opportunity to present evidence on his/her behalf.
